United Kingdom | 12 November 2024I was the Guarantor for my son's car loan. While under warranty, it broke down with various faults, so it was handed back to the garage, as the place was a complete joke. However, the Finance Advisor told us that mileage charges are in the agreement under the Consumer Rights Act 2015, whereby the dealer is entitled to make a fair deduction for usage. They said my son drove over 4000 miles, which I doubt as the car has been to the garage five times in eight weeks and has not been used. I was then put under pressure to sign off on £900 as Midland told me there could be extra charges if I didn't. My son spoke with a friend who owns Stadium Motors in Sunderland and informed us that unless we have signed or been made aware of the mileage clause in the contract the mileage clause was unlawful and use the FCA to get our money back. I read the contract and no mention of these charges anywhere as well as not been informed by the garage of this mileage clause. Once I informed Midland Credit that they would be reported to the FCA they backed down and the garage returned our money. Midland Credit then told me that they agreed to waive the deduction on this occasion, as a gesture of goodwill which was complete rubbish as they didn't want an investigation into their shady business dealing by the FCA.

Midland Credit have given me the chance and taken this into account. Carys has been extremely helpful throughout the whole process and has replied to all communications really quickly. Would absolutely recommend Midland Credit to anybody. The interest is higher but that's to be expected for people with poor credit and they worked with me to ensure my monthly payments are manageable.
